O deputado Cezinha de Madureira anunciou a apresentação do Projeto de Lei PL 888/2025, que propõe o fim da contribuição obrigatória ao Escritório Central de Arrecadação e Distribuição (ECAD). A medida visa alterar o atual modelo de cobrança de direitos autorais sobre músicas executadas em rádios, eventos e estabelecimentos comerciais.
Segundo o parlamentar, a proposta busca garantir mais liberdade para rádios comunitárias, igrejas e pequenos empresários que utilizam músicas em suas atividades. “O ECAD tem sido um peso financeiro para muitos setores, e é preciso rever essa obrigatoriedade para equilibrar os interesses dos artistas e da sociedade”, argumenta Cezinha.
O projeto deve gerar debates intensos entre os defensores dos direitos autorais e os setores que reivindicam mudanças no sistema de arrecadação. Atualmente, o ECAD é responsável pela arrecadação e distribuição dos valores pagos pelo uso de músicas no Brasil, garantindo a remuneração de compositores, intérpretes e produtores.
A proposta do deputado ainda será discutida nas comissões antes de seguir para votação no plenário da Câmara. Enquanto isso, representantes da classe artística e setores econômicos impactados se mobilizam para defender seus interesses no Congresso Nacional.

Comissão aprova fim do Ecad e criação de centro de arrecadação de direitos autorais
No DIa 12/04/2017 A Comissão de Finanças e Tributação aprovou proposta que extingue o Escritório Central de Arrecadação de Direitos (Ecad), substituindo-o por uma nova entidade, o Centro de Arrecadação e Distribuição de Direitos Autorais (Cadda), com regras mais rígidas.
Relator na Comissão de Finanças e Tributação, Enio Verri apresentou parecer pela aprovação da proposta
O texto aprovado é o Projeto de Lei 2850/03, da Comissão de Legislação Participativa, e tem origem em sugestão da Casa do Compositor Musical, entidade sem fins lucrativos situada no Rio de Janeiro.
Obras protegidas
De acordo com a proposta, o compositor é o titular da obra. Portanto, a utilização desta depende de autorização prévia. O autor tem direitos morais e patrimoniais sobre a composição, independentemente de registro.
O texto protege as composições musicais que tenham ou não letra e suas adaptações e traduções.
Para se identificar como compositor da obra musical, o criador poderá usar seu nome civil completo, abreviado, suas iniciais ou pseudônimo. Quem adaptar música de domínio público terá os mesmos direitos reservados para o compositor musical.
Direitos
O compositor terá direito de reivindicar, a qualquer tempo, a autoria da obra; conservar a obra inédita; assegurar-lhe a integridade, opondo-se a quaisquer modificações; e retirar a obra de circulação ou ainda suspender a utilização já autorizada quando a circulação implicar afronta à sua reputação.
O autor também poderá ter acesso a exemplar único e raro da obra que estiver em poder de outra pessoa, a fim de preservar sua memória. Quando o autor morrer, os direitos autorais serão transmitidos a seus sucessores. As músicas elaboradas em coautoria não poderão ser reproduzidas sem consentimento de todos os autores.
Auditoria
Relator na comissão, o deputado Enio Verri (PT-PR) defendeu a aprovação do projeto e apresentou parecer pela não implicação da proposta em aumento ou diminuição da receita ou despesa públicas.
Pelo projeto, o Cadda terá os seus gastos limitados a 20% do valor bruto recolhido com direito autoral e passará por uma auditoria independente das suas contas a cada dois anos.
O órgão máximo do Cadda será um conselho diretor com cinco integrantes com mandatos de três anos, eleitos pelas associações sem fins lucrativos para o exercício e defesa dos direitos de autores.
Tramitação
O projeto foi rejeitado anteriormente pelas comissões de Ciência e Tecnologia, Comunicação e Informática; e de Educação e Cultura.
À época, a proposta seguiu para ser analisada pela Comissão de Constituição e Justiça e de Cidadania.
